These Terms of Service ("Terms") govern your use of buyfirestop.com and any purchase you make from American Fire Safety Supply LLC ("AMFSS," "we," "us," or "our"). By accessing this site or placing an order, you agree to these Terms. If you do not agree, do not use the site.
1. Who We Are
American Fire Safety Supply LLC is a Texas-based distributor of firestop, marine, and industrial safety products. Our registered business address and contact information are available upon request at [email protected]. We sell to both businesses (B2B) and individual consumers in the United States and internationally where permitted.
2. Use of This Site
You may use this site for lawful purposes only. You agree not to:
- Scrape, harvest, or systematically download product data or pricing without our written consent;
- Use the site to transmit spam, malware, or fraudulent orders;
- Attempt to gain unauthorized access to our systems or customer data;
- Reproduce or redistribute our product content, images, or descriptions for commercial use without permission.
We reserve the right to suspend or terminate access for violations of these Terms.
3. Product Descriptions and Accuracy
We make reasonable efforts to ensure product descriptions, specifications, images, and compatibility information are accurate. However, manufacturer specifications and installation details in official data sheets and system approvals are authoritative. Product images are representative — packaging and labeling may vary. If you have questions about a product's suitability for a specific application, contact us before ordering.
4. Pricing
All prices are in US dollars and are subject to change without notice. Prices shown at the time of checkout are the prices you will be charged. In the event of a pricing error (including but not limited to typographical mistakes), we reserve the right to cancel the affected order and notify you. We will not fulfill orders at clearly erroneous prices.
Sales tax is collected where required by law based on the shipping destination. Tax-exempt customers must provide a valid exemption certificate before placing an order; exemptions cannot be applied retroactively.
5. Orders and Acceptance
Submitting an order constitutes an offer to purchase. Your order is accepted when we send an order confirmation email or ship the goods, whichever occurs first. We reserve the right to decline or cancel any order for any reason, including stock unavailability, suspected fraud, or pricing errors. If we cancel your order, we will refund any charges in full.
6. Order Cancellation
Orders may be cancelled without charge if they have not yet shipped. To request cancellation, contact us promptly at [email protected] with your order number. Once an order has shipped, it is subject to our Return Policy (Section 8). Special-order, custom, or made-to-order items cannot be cancelled once production or procurement has begun.
7. Shipping
We ship from our warehouse(s) in the United States via common carriers including UPS, FedEx, and freight. Estimated delivery times are provided at checkout and are not guaranteed unless expedited shipping is selected and confirmed. Risk of loss and title pass to you upon tender of the shipment to the carrier.
We are not responsible for delays caused by carrier issues, weather, customs clearance (for international orders), or incorrect shipping information provided by the customer. Freight damage claims must be noted on the delivery receipt and reported to us within 2 business days of receipt.
8. Returns and Exchanges
We accept returns of unopened, resalable products within 30 days of delivery, subject to the following:
- Items must be in original, undamaged packaging.
- A restocking fee of up to 20% may apply to non-defective returns.
- Return shipping costs are the customer's responsibility unless the return is due to our error or a defective product.
- Hazardous materials and products with regulatory restrictions may not be returnable due to shipping regulations.
- Special-order or custom items are non-returnable unless defective.
To initiate a return, email [email protected] with your order number and reason. Do not ship returns without a return authorization number.
9. Warranties
Products sold by AMFSS carry the manufacturer's warranty, if any. AMFSS does not separately warrant products beyond what the manufacturer provides. We will reasonably assist customers in pursuing valid manufacturer warranty claims. AMFSS makes no warranty that products are suitable for any particular application — it is the buyer's responsibility to verify compliance with applicable codes, standards, and the authority having jurisdiction (AHJ).
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMFSS AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THIS SITE OR PRODUCTS PURCHASED FROM US, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM A TRANSACTION SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
Nothing in these Terms limits liability that cannot be excluded by applicable law.
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any legal action arising from these Terms or a transaction with AMFSS shall be brought exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.
12. Dispute Resolution
We prefer to resolve disputes informally. If you have a concern, contact us at [email protected] and we will make a good-faith effort to resolve it. If informal resolution fails, disputes shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except that either party may seek injunctive or other equitable relief in court. The arbitration shall be conducted in Texas, or by telephone/video if mutually agreed. You waive the right to participate in a class action.
13. Intellectual Property
All content on this site — including text, images, logos, product descriptions, and code — is owned by AMFSS or used with permission. You may not reproduce or use our content for commercial purposes without written authorization. Manufacturer product names, logos, and trademarks belong to their respective owners.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the site after changes are posted constitutes acceptance of the revised Terms. For significant changes, we will make reasonable efforts to notify registered customers by email.
