US State Privacy Rights

Several US states have enacted comprehensive privacy laws that give residents specific rights over their personal data. This page describes those rights and how to exercise them with American Fire Safety Supply LLC ("AMFSS"). It supplements our Privacy Policy.
1. Covered States
The rights described here apply to residents of:
- California — California Consumer Privacy Act (CCPA) as amended by CPRA;
- Colorado — Colorado Privacy Act (CPA);
- Virginia — Consumer Data Protection Act (VCDPA);
- Connecticut — Connecticut Data Privacy Act (CTDPA);
- Texas — Texas Data Privacy and Security Act (TDPSA).
Residents of other states with applicable laws may also have similar rights. We will honor reasonable requests from residents of any US state with applicable privacy legislation.
2. Categories of Personal Data We Collect
We collect the following categories of personal information:
- Identifiers: name, email address, phone number, IP address;
- Commercial information: purchase history, products ordered, returns;
- Financial information: payment method type and billing details (full card numbers are handled by our payment processor, not stored by us);
- Internet activity: pages visited, session data, cookies;
- Geolocation: shipping address, approximate location from IP address;
- Professional information: company name, job title (for B2B customers who provide it).
We do not collect sensitive personal data as defined under applicable state laws (e.g., social security numbers, precise geolocation beyond shipping address, genetic data, health data).
3. How We Use Personal Data
We use personal data for the purposes described in our Privacy Policy: order fulfillment, customer service, fraud prevention, legal compliance, and (with consent or as permitted) marketing communications.
4. Sale or Sharing of Personal Data
We do not sell your personal data to third parties for monetary consideration. We do not share personal data for cross-context behavioral advertising. We share data only with service providers acting on our behalf (shipping carriers, payment processors, e-commerce platform) under data processing agreements that restrict their use of your data.
California residents: AMFSS does not "sell" or "share" personal information as those terms are defined under CCPA/CPRA. You nonetheless have the right to opt out; to exercise it, contact us at [email protected].
5. Your Rights
Right to Know / Right of Access
You may request that we disclose: the categories of personal data we have collected about you; the purposes for which it is used; the categories of third parties with whom it is shared; and a copy of the specific personal data we hold about you.
Right to Delete
You may request deletion of your personal data. We will comply unless we are required to retain it by law (e.g., tax records) or to complete a pending transaction.
Right to Correct
You may request correction of inaccurate personal data we hold about you.
Right to Opt Out of Sale/Sharing
As noted above, we do not sell or share personal data. If you believe we are doing so, or want to register your opt-out preference, contact us at [email protected].
Right to Data Portability
Where technically feasible, you may request a copy of your data in a portable, machine-readable format.
Right to Non-Discrimination
We will not deny you goods or services, charge you different prices, or provide a different level of service because you exercised a privacy right. However, if a data request prevents us from completing your transaction (e.g., you request deletion of your shipping address mid-fulfillment), we may need to cancel the order.
6. Sensitive Personal Data (California CPRA)
We do not collect sensitive personal information beyond what is necessary to process your order (billing/shipping address, payment method). We do not use or disclose sensitive personal information for purposes other than those permitted by CPRA without your consent.
7. How to Submit a Request
To exercise any of the rights above:
- Email: [email protected] — include "Privacy Request" in the subject line;
- Include your full name, email address used for purchases, and the specific right(s) you wish to exercise.
We will verify your identity before processing your request. We may ask you to confirm the email address on your account or provide order information to verify you are the consumer making the request (or their authorized agent).
8. Response Timeframes
- Acknowledgment: within 10 business days of receipt;
- Response: within 45 calendar days. If we need more time (up to 45 additional days), we will notify you before the initial deadline.
We may decline requests that we cannot verify, that are manifestly unfounded or excessive, or that conflict with our legal obligations.
9. Authorized Agent Requests
California residents may designate an authorized agent to submit requests on their behalf. We will require written proof of the agent's authority and may still verify your identity directly. Colorado, Virginia, Connecticut, and Texas residents may also use an authorized agent where permitted by applicable law.
10. Appeals
If we decline to take action on your request, we will explain why. You may appeal our decision by responding to our denial email or contacting [email protected] with "Privacy Appeal" in the subject line. We will respond to appeals within 60 days. If your appeal is denied, you may contact your state attorney general:
